Spearfishing in Argentina
In Argentina marine recreational fishing is a provincial jurisdiction (Ley Federal 24.922): each coastal province has its own rule, and the national parks sit under the APN. The product core is the clear-water belt of the Patagonian gulfs: Las Grutas/San Matías → Puerto Madryn/Golfo Nuevo → Camarones, plus Mar del Plata as the Buenos Aires anchor. Cold water, big tides, but this is the historic cradle of the sport (Madryn — National Capital of Diving).
The common thread is reading the water: cold Patagonian water (7 mm), huge tides (in the hyper regime of Río Gallegos/Santa Cruz, hunt only at slack), the sudestada on the Buenos Aires coast, and the Valdés whale season (June–Dec). This guide gives the rules by province, walks north to south, and links to a daily forecast for every city.
Otvori vodeću lokaciju — Las Grutas →Rules by province
There's no single national rule — the rules depend on the province. Río Negro has the most modern law (apnea-only, licensed); Chubut has a free permit and is the core of the sport; Buenos Aires is a grey zone (not regulated). Summary:
| Province | Rule for spearfishing |
|---|---|
| Buenos Aires | Pesca Deportiva licence; spearfishing not regulated (grey) — don't take natives, turbid except MdP reefs |
| Río Negro | Ley 5.706/2024: submarina permit; apnea ONLY (no scuba); rubber+pneumatic; buoy; no night |
| Chubut | Ley 1087/73: submarina permit FREE; apnea; Golfo Nuevo prime; Valdés cupo |
| Santa Cruz | No permit; apnea in practice; unregulated outside reserves; cold/turbid |
| Tierra del Fuego | No marine framework; not a destination; banned in the national park |
Clear gulfs, tides and whales
The north-Patagonian gulfs (San Matías/Las Grutas, San José, Golfo Nuevo/Madryn, Camarones) hold the clearest water and are the cradle of the sport. The tides are huge: Golfo San Matías and southern Santa Cruz — macro/hyper regime; in the hyper tide (Río Gallegos, Puerto Santa Cruz) you hunt only in the narrow slack window ±N min, outside it — fully red. A W (offshore) wind cleans and flattens the water — the coast faces east. Valdés whale season (southern right whale, Jun–Dec) — keep away from the whales.
No-take zones
All national parks — banned: the APN (Res 199/2024) expressly bans spearfishing in park jurisdiction and requires releasing natives — PN Islote Lobos (Río Negro), PN Monte León (Santa Cruz), PN Tierra del Fuego. Península Valdés (ANP Chubut) + Golfo San José — a whale reserve: hunting is regulated with a cupo (2 fish >5 kg or ≤4 <5 kg/day), the intangibles closed. Provincial reserves (Punta Bermeja/La Lobería, Ría Deseado) restrict condrichthyans (sharks/rays).
Species and trophies
Flagship — salmón de mar (Pseudopercis semifasciata): rocky «salmoneras» and caves, the main trophy of every hub; long-lived and slow-growing → take sparingly (in tune with the Valdés cupo). Mero (Acanthistius, «wreck fish») — a staple of BsAs reefs and wrecks, peaking in autumn. Pez limón — a narrow summer pelagic (Jan–May). Corvinas — rod only (turbid), not a spearfishing target.
| Species | Region / season / status |
|---|---|
| Salmón de mar (Argentine sandperch) | Patagonian gulfs + MdP; Oct–Mar; flagship, vulnerable |
| Mero (Argentine sea bass) | BsAs reefs/wrecks; peak autumn |
| Yellowtail amberjack | MdP + Golfo Nuevo; summer (Jan–May) |
| Sargo, turco, escrófalo | reefs, warm season |
| Corvinas | turbid → rod, not spear |
Seasonal calendar
The season's core is the austral summer: the north-Patagonian gulfs warm, fish move onto the shallow reefs, visibility rises. In winter the fish go deep and the water is cold year-round (7 mm). Overlay the Valdés whale season (Jun–Dec) on this. Month by month (southern hemisphere):
| Period | Conditions and species |
|---|---|
| Dec–Mar (summer) | Prime: gulfs warm, salmón de mar on the reefs, pez limón in MdP/Golfo Nuevo, best visibility. Valdés whales linger into Dec. |
| Apr–Jun (autumn) | Shoulder: mero peaks on the BsAs reefs and wrecks, the gulfs still work; the water cools, Valdés whales arrive (from June). |
| Jul–Sep (winter) | Weak season: fish deep, cold (7 mm), frequent sudestada in the BsAs north; Valdés whale peak — keep away. |
| Oct–Nov (spring) | The water warms, fish rise onto the reefs, visibility grows; Valdés whales until December; the gulfs come alive. |
Safety
Never dive alone. Cold water (7 mm year-round). In the hyper tide of Río Gallegos/Puerto Santa Cruz — dive only at slack, the currents are deadly; on the macro gulfs follow the tide table. On the Buenos Aires coast — the sudestada. At Valdés (Jun–Dec) — whales, keep your distance. Mark yourself with a buoy. The per-city forecast and the slack window help you pick the safe day.

Česta pitanja
Pravila vrijede za 2026. — propisi su POKRAJINSKI. Río Negro (Ley 5.706/2024): samo na dah, bez noći; Chubut: besplatna dozvola + kvota Valdés; Buenos Aires: podvodni ribolov NIJE reguliran (siva zona). U svim nacionalnim parkovima i na Península Valdés izlov je potpuno zabranjen.
What are the spearfishing rules?
They're provincial. Río Negro (Ley 5.706/2024) — a submarina permit, apnea only, no night. Chubut — a free permit, apnea, Golfo Nuevo prime. Santa Cruz — no permit, unregulated outside reserves. Buenos Aires — there's a Pesca Deportiva licence, but spearfishing isn't regulated (grey zone). Tierra del Fuego — no marine framework.
Službeni izvor ↗Can I spearfish on scuba?
No. Río Negro expressly defines submarina as apnea and bans breathing apparatus and scooters (Ley 5.706 Art.4c). In Chubut the norm/practice is apnea too. The speargun may be rubber or pneumatic, one/multiple prongs; a loaded speargun out of the water is banned.
Službeni izvor ↗What's the Península Valdés cupo?
Península Valdés (ANP Chubut) + Golfo San José — a regulated zone with a whale reserve. Spearfishing is allowed with a licence and a limit (cupo): 2 fish >5 kg OR up to 4 <5 kg per diver per day, no carry-over; the intangibles are closed. It matches the vulnerability of salmón de mar — take sparingly.
Službeni izvor ↗Where is hunting fully banned?
In all national parks. The APN (Res 199/2024) expressly bans spearfishing in park jurisdiction and requires releasing natives: PN Islote Lobos (Río Negro), PN Monte León (Santa Cruz), PN Tierra del Fuego. Plus the Península Valdés intangibles. In provincial reserves (Punta Bermeja, Ría Deseado) sharks/rays are banned.
Službeni izvor ↗Where's the clear water, and when's the season?
The clearest water is in the north-Patagonian gulfs (Las Grutas/San Matías, San José, Golfo Nuevo/Madryn, Camarones). The best season is the austral summer (Dec–Mar) plus the Oct–Apr shoulder: the water warms, fish move onto the shallow reefs, visibility rises. In winter the fish go deep. Pick the day by the city forecast.
Are the Patagonian tides dangerous?
Yes, in the south. Golfo San Matías — macro regime, and Río Gallegos and Puerto Santa Cruz — hyper tides (>10 m): the currents are deadly, hunting is only possible in the narrow slack window ±N min, outside it the card is fully red. In the north-Patagonian gulfs the tides are gentler, but still follow the table. Always dive with a buddy and a buoy.
Do I need a permit, and where do I get it?
It depends on the province. In Río Negro you need a spearfishing permit (Ley 5.706/2024). In Chubut — a free submarina permit, issued by the provincial fisheries office; for Península Valdés/Golfo San José it comes with a cupo. In Buenos Aires you take out a general Pesca Deportiva licence, but spearfishing itself isn't regulated. In Santa Cruz no permit is needed. Sort it in advance and carry it.
