Law
  • •Spearfishing in Australia is governed by STATE law, not federal: the licence, the gear, the closed areas, the sizes and the all differ between NSW, QLD, VIC, SA, WA and TAS. Below is your state's pack; cross into the next state and the rules change at the border.
  • ✓Federally listed species are protected everywhere in Australia, in every state and in Commonwealth waters: white and whale sharks, sawfish, marine turtles, marine mammals and the other listed marine species — never shoot, disturb or take them (Environment Protection and Biodiversity Conservation Act 1999).
  • •Marine park zoning applies ON TOP of the state's fishing rules: / Sanctuary / Preservation zones are full no-take, and on the Great Barrier Reef the marine park zoning sits on top of the Queensland rules. Check the boundaries on the managing agency's zone map before you enter the water.
  • •Two prohibitions coincide in every state we ship a city in: rock lobster may not be taken with a spear or any puncturing device, and all inland (fresh) waters are closed to spearfishing. Abalone may not be speared either. Source: the state fisheries recreational guides.
  • ✓NSW: spearfishing requires the NSW Recreational Fishing Fee to be paid and the receipt carried — AUD 7 (3 days), 14 (month), 35 (year), 85 (3 years). Under-18s, pensioner concession card holders and Aboriginal people are among the exemptions (Fisheries Management Act 1994).
  • •NSW gear (per DPIRD): mask and snorkel yes, scuba to take fish no (scuba is only for scallops and sea urchins), hookah banned. A light used TOGETHER with a spear or speargun is banned, so night spearfishing with a torch is not allowed. and explosive devices are banned.
  • ✓NSW closed spearfishing places (per DPIRD): ocean beaches are closed except the last 20 m at each end; a long schedule of entrances, coastal lagoons and tidal waters is closed; marine parks and aquatic reserves add their own restrictions (Marine Estate Management Act 2014). Code of practice: keep 50 m from swimmers and divers, cover the spear tip on land.
  • •NSW sizes and seasons: a spearfisher has the same bag and as every other recreational fisher. Key ones: snapper 30 cm (bag 10), kingfish 65 cm (5), dusky flathead 36–70 cm slot (5), mulloway 70 cm (1), luderick 27 cm (10). Australian bass and
Safety protocol
  • Sets: watch the wave trains ≥15 min before entering; Hmax ≈ 2×Hs, the wash can run 50 m past the foam line. A lull >10 min with period >12 s = a big set «overdue», do NOT enter; enter right after a full set passes and re-check at minute 30.
  • Exit FIRST: find your exit AND a backup before entering. On a rocky/boulder shore a 0.5 m rise in swell can make the exit impossible — getting pinned/unable to climb out is the main killer.
  • Headland rip: prominent points often have a permanent topographic rip regardless of the model — locate it, enter/exit on the windward side, never swim against it.
  • Cold: wetsuit per the SST chip; the first shiver = a metabolic surge and a drop in breath-hold → get out at the first steady shiver. Cap the session at 45–60 min below 15 °C.
  • Solo discipline: buoy up; tell someone the spot and exit time; conservative breath-hold (never push it in cold/murky/surfy water); visibility <3 m — don't enter.
  • Afternoon wind: on many coasts the wind builds from midday — plan to be out of the water by midday; the chop builds — get out.
  • UV 11:00–15:00 (UVI ≥6): sunscreen and cover up on the surface interval.
  • Solo is a fundamental risk (hypoxic blackout with no buddy). Any doubt = No-go.

Spearfishing in Sydney — Northern Beaches: spots, seasons and rules

Spearfishing on Sydney Northern Beaches is legal only when the spot, species and method all line up. Shelly Beach and Cabbage Tree Bay are no-take sanctuary water, so they are for snorkelling, not hunting. North Curl Curl offers shallow reef and ledges outside that closure when swell is low. Long Reef is different from Cabbage Tree Bay: finfish spearfishing can be permitted there, while plants and invertebrates are protected, but current NSW DPI rules should be checked before diving. Pay the NSW Recreational Fishing Fee and leave blue groper alone.

  • Sydney Northern Beaches spearfishing starts by crossing Shelly Beach and Cabbage Tree Bay off the hunting list.
  • North Curl Curl is the cleaner shore-hunt option in small swell; Long Reef needs a current aquatic reserve rule check.
  • E to SE swell, rock-platform exits, surfers and boat traffic make conservative timing more important than distance offshore.
  • NSW requires the Recreational Fishing Fee, and eastern blue groper is protected from spearfishing.

Sydney Northern Beaches spearfishing entries and closures

This coastline has good reef close to shore, but it also has famous protected water and busy surf zones. Make the plan from the map outward: remove sanctuary areas first, then judge swell, platform exit and crowding. If the sea is too big for a clean rock return, the legal status of the reef does not make it a good dive.

    When do the Northern Beaches get clear water?

    Small swell, light westerly wind and a calm lead-up are the usual signs. E and SE swell hit the platforms directly, pushing white water through gutters and making exits slippery. North Curl Curl needs special caution at low platforms, because a short period pulse can change the return. Long Reef has more water around it but also more exposure and walking distance.

    Can you spearfish at Shelly Beach?

    No. Shelly Beach sits in Cabbage Tree Bay Aquatic Reserve, a no-take sanctuary. It is one of Sydney best-known fish-watching sites because fishing pressure is removed. Do not carry a speargun there as a backup plan, and do not collect shellfish or plants. If Manly looks perfect but the open coast is rough, switch to snorkelling or wait for a better shore-diving day.

    How should Long Reef be treated?

    Long Reef is useful precisely because it is not the same rule set as Cabbage Tree Bay. Line fishing and finfish spearfishing are allowed in the reserve, while invertebrate and plant collection is banned. That still leaves room for seasonal closures, species limits or updated management. Check the NSW DPI page or map on the day, and never take lobster, abalone or other invertebrates there.

    What fish and rules matter in NSW?

    Northern Beaches reef is classic NSW wash country: drummer, bream, luderick, snapper, trevally and yellowtail kingfish in better water. Keep only fish that meet current size and bag rules. Eastern blue groper is protected from spearing; black cod, grey nurse shark, white shark, seahorses and seadragons are also protected. The NSW Recreational Fishing Fee applies unless you are exempt.
